Purchase Contract
This web site is operated by
Carpets And More Ltd ("we", "us" or "our"). All
purchases made on this web site are governed by these Terms and Conditions at
any time although the Terms and Conditions governing any given purchase will be
those in effect at the date of your order. If you order goods after we have
published the changes you will be bound by those changes. Accordingly, you
should check prior to each order to ensure that you understand the precise
terms and conditions applicable to your purchase.
We will confirm acceptance of
your order. This will occur either by message on the website immediately after
you have confirmed your order, or by us sending an e-mail to the email address
you have provided to us. We may do both, in which case the acceptance will
occur on whichever arrives sooner of the web message and the email. At this
point the purchase contract will be made and we will supply the goods to you in
accordance with your order and these Terms and Conditions.
Prices
All prices are in UK Pounds and
are inclusive of VAT where applicable, at the current rate. The price of the
goods will be as quoted on the web site at the time you confirm your order
(usually by clicking the "checkout" button) subject only to any
inadvertent technical error for which we will not be liable. If you
subsequently amend your order, the prices charged will be those applicable to
the amended item(s) at the time that the amended order is confirmed. Please
note that as promotions are offered for a limited period of time subsequent
amendments to your order may mean that certain promotions are no longer being
offered.
The price of the goods does not
include a charge for delivery. Certain areas may incur a delivery surcharge,
such as (but not exclusive to) certain parts of Scotland, the Highlands or the
Isles.
Products & Availability
Although we endeavour to hold
stock of all the items advertised for sale on our site this cannot be
guaranteed, so that by acknowledging receipt of your order we are not creating
a binding contract to supply what you have ordered but which we do not have in
stock. The content of the site is managed daily and therefore we do our very
best to keep these up to date.
In the event of unavailability for whatever reason, we will advise you of our position when we receive your order and we will await your subsequent instructions. We cannot be held responsible for the unavailability of stock due to it being discontinued by the manufacturer, or any delay caused by manufacturer in producing the product(s).
Please note that we cannot guarantee that all batches of flooring will be the same as it is impossible to guarantee this. Samples are for indication purposes only and may not represent the latest available batch of the floorcovering. Colours and quality will be within tolerance of what the factory production of that particular product is. Carpets And More cannot be held liable and accepts no responsibility of any batch difference.
The images of the Goods on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the Goods. Your product may vary slightly from those images.
Delivery
Orders will normally be dispatched to the distribution centre within 24 hours. Normal postal lead times (provided your flooring is not coming from the EU) are; England, Scotland and Wales: 3-7 working days, but please allow up to twenty-one days for delivery. We will always do our best to inform you about any delay and endeavour to get your purchase to you as soon as possible.
Delivery is a one-man delivery, and the delivery driver may require assistance for larger items.
Deliveries where possible are to ground floor only, drivers are not insured to go upstairs.
In the instance that access is difficult, it may need to be a curb-side delivery.
Although every effort is made to deliver your flooring on a selected date, Carpets And More cannot be held responsible or liable for any delay or cost caused by delay. Delivery dates selected at checkout are not guaranteed, though we endeavour to get them to you for this date, our team will contact you to book in the delivery of your order at the earliest opportunity.
Returns and exchanges
We believe you will be delighted
with your purchases but there may be occasions when you feel it necessary to
return an item.
You have the right to cancel the
contract for the purchase of any item within seven days of delivery, however
this will be subject to handling charges for re-stocking/
administration charges of 40% +VAT of the value of the product(s).
In the case where the flooring
you have purchased is cut to your measurement, such as (but not exclusive to)
carpet for example, or if a pack of laminate/LVT has been removed form it's
packaging, the items are deemed bespoke and cannot be refunded.
Once an order is dispatched,
either from our stock or from our suppliers, and you wish to cancel prior to
receiving the goods, the re-stocking/ administration charges aforementioned may
still apply, as the goods will have left either our warehouse/suppliers
warehouse. In the case where the product is cut to size, or a special order (i.e. ordered in especially, to your size) such as but not
exclusive to carpet, then a refund is not applicable once the product has been
cut or dispatched.
Please note that you will be
responsible for the costs of returning the goods to us unless we delivered the
item to you in error.
In the unlikely circumstance that
your order is faulty - please make sure you inform us in writing within seven
days of receiving it, prior to cutting or installing it, along with photo
evidence which can be sent to us via email to: [email protected].
If you wish to cancel an order
and would like a refund, please ensure that you receive a refund reference
number from us first to authorise your refund.
If we are exchanging your
floorcovering with a replacement due to the original being faulty for example,
the original order will need to be collected and swapped with the courier on
the same visit that the replacement occurs. The original floorcovering needs to
be wrapped in its original packaging and clearly have our reference on it.
Carpets And More accept no
responsibility for a product that has been wrongly fitted or damaged whilst
fitting, and cannot return any product once it has been fitted. If a floorcovering is faulty or incorrect, Carpets And More must be informed of this prior to it being cut or installed.
Warranty and Liability
All manufacturer warranties and
guarantees are valid for the products purchased through Carpets And More as
they are all A grade.
Nothing in these Terms and
Conditions will restrict any of your statutory rights.
In addition that outlined above
we will not be deemed to be in breach of contract or of these Terms and
Conditions as a result of any delay in our performance or failure to perform our
obligations if that delay or failure to perform is due to any cause or
circumstance beyond our reasonable control including, but not limited to, fire,
flood and other acts of God, strikes, riot, accident, disruption to energy
supplies, civil commotion, acts of terrorism or war.
Other than as set out above, our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods contained in that order.
